Before requesting a graphic
from me, please read the following, very carefully:
You can click on the policy to read more information if you want to.
I reserve the right to change or modify these as I please and any changes apply
to past, current and future graphics.
We

Avatar Request Form or
Other Graphic Request Form
I now
host all request graphics on TinyPic,
a free image hosting website where an account is not required in order to
upload an image.
The only catch with using this site is that if the graphic has not been
viewed for 90 days, it is deleted. I suggest that you save it to your
computer, just in case this happens. If it is deleted, you can always use
TinyPic to upload it, again!

Once
your graphic is complete, it is yours to do with as you wish (with the
exception of making changes to it; see the next policy
for information on this). If you decide
to share it with others, you do not have to give me credit UNLESS
someone asks.
For
example, posting a link that simply says "My Avatar" and links to the avatar
is just fine; you don't have
to say "made by Duchess" after it.
However, if someone says "Hey, who made
you that avatar?" I expect you to tell them the truth. I don't think that's
asking for too much.
I
have worked hard on these and would simply like the credit when credit is
due. If I find out that you are claiming, elsewhere, that you created
something that I made for you, I will be very unhappy and find a way to make
sure that the people you have told know you are lying. You won't like it.

I work very hard on my graphics and they are mine. I will
happily give you the final image of the work you requested, but you are not
entitled to the .psd file that I created and you do NOT have the right to
change ANYTHING on the final image I give you unless I have given you
permission to do so, first.

If you request a copyrighted
image, background, font, etc, I will use it at your request, HOWEVER, you
acknowledge that by requesting that copyrighted item, YOU are responsible
for any lawsuits or issues of any kind that may arise, not me.
Don't get me wrong, it is VERY
unlikely that Nintendo is going to try to sue one of us for using an Animal
Crossing character on a fansite avatar, but there are sometimes pictures,
items or characters that the creators do NOT want people taking, even for
personal use with no monetary gain. If you happen to choose something like
this, you just have to be aware that the responsibility is yours for
requesting it, not mine for making it.

I reserve the right to refuse your request without
explanation.
At any time, for any reason, I
may decide not to accept your request. This also means I can decide to
change my mind if I've already acknowledged your request and told you I will
work on it (this is especially likely if you're pestering me about it). If I choose to do so, I owe you no
explanation whatsoever.
This is not to say that I won't give you one, but if
I decide not to, that is my decision. Begging, pleading, threatening, etc.
will not work. In fact, it will likely make me that much more sure that I
don't want to do anything for you.

You may NOT request more than 5
items (unless you've gotten permission from me, first).
I do not have an 'avatar shop'
on any of the websites I'm on, but word of mouth has spread fairly well for
the items I make, so I often have a fair number of requests. For this
reason, I have implemented a 5 item limit, per person, unless you have
contacted me, first.
If you've ordered more than 5
items from me and would like more, feel free to ask! I really only have the
rule for when times are busy and I want to make sure that everyone who
hasn't gotten one is able to before I allow people who have several to
request more.

Particularly in the case of
fonts, there are many websites that ask you to pay anywhere from 99¢ to
$24.99 for a single font. I will not do this. I am not making money from
these graphics, therefore it is ridiculous to ask ME to pay for something to
make a graphic for you.
If you find a font you like on a site that requires
you to pay, I suggest you start looking for a font that looks similar to it
on a website like Font Freak,
Urban Fonts, or
another free font website.

I work hard on these and, once
the graphic is done, I will add it to my gallery for showcasing. If you
wish to remain anonymous, please inform me and I will change the name on the
avatar or other graphic so that no one will know it was you that requested it.
Do not ask me
not to add the graphic at all, because I will refuse. I made it, and I
retain credit for it.
